Brandina S.r.l. constantly strives to protect the online privacy of its users.

This document will allow you to learn about our privacy policy to understand how your personal information is handled when you use the Brandina Service.

Personal data controller 1.

The undersigned BRANDINA SRL unipersonal company - with registered office in Via Libertà n.2 47841 Cattolica (RN) and operative office in Strada della Fabbreccia n.40 61122 Pesaro (PU) - VAT Number/Fiscal Code 04107010409 Tel. 0721283588, mail fuel@marcomorosini.com, Pec brandina@pec.it, as the Data Controller, provides some information on the collection of your personal data.

2. Purposes of the processing - Legal basis of the processing
a) Personal data are processed as part of the activity of our Company for purposes related to the sale of Brandina branded products linked to a contract (legal basis of the processing, Article 6, paragraph 1, letter b) of the Regulations). The processing that the Data Controller intends to carry out has the purpose of enabling the provision of the Brandina Service requested by the user with the registration and creation of their profile, including the collection, storage and processing of data for the purposes of the establishment and subsequent operational, technical and administrative management of the relationship (and the profile created by the user) related to the provision of the Brandina Service and the execution of communications relating to the conduct of the relationship established. The data collected from users, subject to processing, are processed and used directly to fulfill purposes instrumental to the fulfillment of the activity such as: to be able to follow up on your reservation request, with reference to the processing of the request and the fulfillments, including legal, administrative, accounting and tax related to the reservation; to verify the completeness, validity and correctness of the data provided, also in order to avoid computer fraud; to be able to manage correspondence, communications and service reports with you; access to present and future promotions.

b) Brandina may use the data concerning you, subject to your necessary and explicit consent, also for purposes functional to the activities listed below: sending advertising/promotional material; direct mailing and direct e-mailing activities in order to send you notices related to our activities and to provide you with additional and personalized services; direct mailing and direct e-mailing activities with commercial or advertising purposes of the services promoted by Brandina S.r.l.; market research; market analysis activities, economic/statistical surveys.

c) Brandina may use data about you, subject to your necessary and further explicit consent, also for the purpose of profiling i.e. automated processing of data to analyze aspects of your preferences or interests - by third-party processing systems or companies and the subsequent sending of advertising material in connection with this activity.

3. Methods of data processing

Data processing is carried out mainly by means of IT tools and in the manner indicated by the legislation (Art. 5, EU Reg. 2016/679), which provides, among other things:

  • processed in a lawful, correct and transparent manner ("lawful, correct and transparent");
  • collected for specified, explicit and legitimate purposes as set out above and subsequently processed in a way that is not incompatible with those purposes ("purpose limitation");
  • adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed ("data minimisation");
  • accurate and, where necessary, kept up to date; every reasonable step is taken to ensure that data which are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay ("accuracy");
  • retained in a form that allows the identification of data subjects for a period of time not exceeding the fulfillment of the purposes for which they are processed-see Section 8 of this policy ("limitation of retention");
  • processed in such a way as to ensure appropriate security of personal data, including protection, by appropriate technical and organisational measures, against unauthorised or unlawful processing and accidental loss, destruction or damage ("integrity and confidentiality").

 

4. Categories of authorized subjects
We inform you that the personal data you have provided or acquired may be processed within the holder's structure by personnel authorized to process the data, pertaining to the ADMINISTRATIVE - ACCOUNTING functions.

 

5. Categories of recipients of personal data
External parties may also have access to the data (e.g. third party technical service providers, postal couriers, hosting providers, IT companies, communications agencies, professional firms, consulting firms, etc.), all of whom are appointed as External Data Processors. The data will also be communicated to the Company that manages the e-commerce platform, when you dedicate to make your purchases by credit card or similar.

The updated list of external parties can always be requested from the Data Controller.

The data may also be processed by individuals, entities or authorities who can access the data by virtue of legal provisions. However, your data will not be disseminated.

It is implied that where you decide to use the Service to knowingly disseminate on the Internet particular information about yourself, such an assumption does not constitute dissemination by the data controller.

 

 

6.Data transfer abroad
The Company does not make any data transfers to non-EU countries. Should this happen in the future, safeguard clauses and guarantees for data protection will be properly evaluated. . In case the customer proceeds to purchase products in e-commerce and opts for payment through credit card, the payment will be handled through the Company Shopify International Ltd - Data Protection Officer c/o Intertrust Ireland 2nd Floor 1-2 Victoria Buildings Haddington Road Dublin 4, D04 XN32 Ireland.

7. Rights of the data subject (Art. 15 et seq. EU Reg. 2016/679)
The undersigned Company informs that there are specific rights of the data subject:
- Right of access to one's own personal data (Art. 15);
- Right to rectification (Art. 16);
- Right to erasure of data (so-called Right to be forgotten), without undue delay if certain grounds provided by law apply (Art. 17);
- Right to restrict processing (Art. 18);
- Right to data portability i.e., the right to transmit data from one Controller to another Controller without hindrance (art. 20);
- Right to object to processing (art. 21) including for profiling purposes;
- Right to obtain non-completely automated decision making (art. 22);
- Right to complain to a supervisory authority (art. 77).

 

8. Retention periods

Data will be kept and processed for the time necessary to process the request and for the duration of any contractual relationships established. The data may also be kept after the end of the contractual relationships for tax reasons and always in compliance with the law. In case of marketing consent, data will be kept until a formal request for deletion.

 

9. Nature of provision and consequences of refusal to respond
In application forms, some information is mandatory, others optional.

Providing mandatory data is necessary in order to follow up on purchase and/or reservation requests, and a refusal to fill them out may result in an objective impossibility for the Owner to fulfill the user's requests.

The provision of other data for further purposes, such as sending advertising/promotional material is optional: your refusal will prevent Brandina from proceeding with these activities.
However, we remind you that your consent can be revoked at any time without affecting the lawfulness of the processing based on the consent previously given.
